The OFT is a regulator set up by Her Majesty’s Government of Gibraltar. The OFT’s legal framework is enshrined within the Fair Trading Act 2015 and its subsidiary legislation.

Three pre-existing Government departments have merged to create the OFT: the Department of Consumer Affairs, the Trade Licensing Section and the Business Support Unit. The OFT therefore takes over the responsibilities of these departments, while at the same time becoming responsible for the implementation of the new business licensing regime, the new Consumer Protection Enforcers and the establishment of the Single Point of Contact, all of which are created by the Fair Trading Act 2015.

The OFT’s primary objectives are to protect the interests of consumers in Gibraltar, to ensure a fair market is maintained, to regulate Gibraltar businesses and to facilitate the establishment of new businesses in Gibraltar. It shall meet these objectives by encouraging businesses to comply with consumer law, by prohibiting unfair practices, by undertaking efficient licensing and regulatory work and by issuing information and educational guidance.
